Terms of Service

1. Acceptance

By using thecustomphotobooth.com (the "Site"), you agree to these Terms. If you do not agree, do not use the Site.

2. The Site and Build Your Booth

The Site lets you design a booth and submit a request. A submitted build is a request for information and pricing. It is not an order or a binding contract. Any rental, purchase, lease or partnership placement is governed by its own separate written contract. Rentals, purchases, leases and partnership placements each have their own contract, and if that contract conflicts with these Terms, the contract controls for that service.

3. Availability

Services are offered nationwide, subject to availability. Partnership placements are available for select, approved high volume locations, at our discretion.

4. Saved build links

Saved build links can be opened by anyone who has the link. Do not include confidential information in a saved build.

5. Your content

You represent that you own or have permission to use any artwork, logos or text you upload, and that it does not infringe the rights of others or violate any law. You grant us a limited license to use it to prepare designs, quotes and your booth. We may decline content at our discretion.

6. Our content

The Site, its design, illustrations, text and marks belong to The Custom Photo Booth Co. or its licensors. You may not copy or reuse them without permission.

7. Payments

Payments for installed booths may be processed by Stripe, subject to Stripe's terms. Payment terms for our services are set out in the applicable agreement.

8. Translation

Translations offered through the footer language picker are provided for convenience and may not be accurate. The English version controls.

9. Acceptable use

Do not misuse the Site, interfere with its operation, attempt unauthorized access, or submit unlawful content.

10. Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

11. Limitation of liability

To the fullest extent permitted by law, The Custom Photo Booth Co. is not liable for indirect, incidental, special or consequential damages arising from use of the Site.

12. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict of law rules. Any dispute arising from these Terms or your use of the Site will be resolved by binding arbitration in Las Vegas, Nevada, under Nevada law.

13. Changes

We may update these Terms. The effective date above shows the latest version.
